    No, they are not. At a port of entry, until they get through it, they have no rights.

    LPR/GC holders can be denied entry, so too can non-immigrant visa holders. There is no guarantee that visa holders be allowed entry or re-entry once they leave. The only person with the right to enter the US is a US Citizen, and even they can be detained.

    If the employer is presented with the work authorized papers as required by the I-9, then it is the employee who should be blamed, as the employer did what was required of him/her by way of the I-9. If you remember the meat packing raids under Bush, the many illegal employees were hired via the HR department who was of the same ethnicity as the employees and were the ones doing things illegally, not the employer.

    Now if the employer is paying cash to whomever, good luck in finding the employee or the employer.

    You still don't get it. When a foreigner is in American soil the Fourteenth Amendment automatically kicks in to protect them. That is the whole premise of this discussion. Pay attention next time!

    The linked article is talking about immigration in general, to which my posting #4 covered.
    Illegals are only entitled to the 14th's Equal Protection and Due Process of the individual states law in which they are if they are charged with a state crime. They are also covered under the 5th and 6th Due Process clauses regarding Federal Crimes. Beyond that, their rights are very limited.

    Visa holders within the US have almost all the same rights and protections as US Citizens.

    Aliens/visa holders/persons outside the US have no rights until they are granted entry.
