    You can't smear someone who is known well for scandalous acts. That's true in practical fact and in law --- I can accuse you of certain illegal actions, but if you are a known criminal, any defamation lawsuit you bring against me will most likely fail because you can't claim damages. Your reputation would be shit, I couldn't have made it worse with an additional accusation.

    O'Reilly hasn't had a good name for years except the name Fox News and his viewers chose to grant him, the former for profit and the latter out of unfounded faith. But he kept ruining that, kept facing accusations that left FNC no choice but to settle even though it has the best legal talent money can buy. Finally it got bad enough that Rupert Murdoch had enough, and that is a significant thing indeed. Murdoch stands by his man. His sons may operate differently (though not too differently, see phone hacking) but it was ultimately Murdoch's call to not only get rid of O'Reilly but to deny him the dignity of a farewell message.
