    The link does not support the contention that accidental discharge is illegal. In fact, it says the opposite - that the trigger must be pulled intentionally (among other elements).

    Hardly. There is no way a lawyer could argue to another jury that "the jury in case X went this way, and you should, too." A determination of fact in one case has no bearing on a determination of fact in another case. The law is applied to the facts of the present case.

    And to the degree these defensive statements are legally relevant, it is the jury's job to determine whether the statements are credible.

    I once observed an M-16 go off on automatic, by itself, with the safety on. So did the guy it was issued to, and so did the drill sergeant who took it from him to demonstrate that no such had happened.

    Well, apparently the jury believed that this guy just happened to find a high end/very expensive automatic pistol in cocked position wrapped in a tee-shirt just laying under a chair on a busy pier.

    So they were a very open minded group of people.

    From the article: "The gun, a Sig Sauer P239 pistol, is a backup emergency weapon used by law enforcement that has a light trigger mode and no safety." This is the info the jury got on the gun. They can only come to a conclusion based on what they're told and that's what they were told. So again, the jury came to the only decision hey could based on the evidence presented to to them and the instructions they were given.

    Thing about that is that you still have to pull the trigger to fire it.
