    According to news reports I saw, the gun involved had no safety. The defendant claimed he found it and it fired when he accidentally dropped it. Might not be a claim the jury could ignore, seeing as the bullet hit the cement floor before richocheting and killing the victim. And the defendant had no history of violence.

    Is it criminally negligent to drop a gun, if someone is shot? Many cases of the phenomenon suggest no, that is not the requisite level of intent.

    He claims he found the gun moments before he dropped it and it fired. If believed, this fails as "possession", IMO.

    Whining about something you have no control over is not going to change the outcome.

    I prefer to focus on the new charges brought against him and hoping those will stick (I also thought the jury was wrong in this instance, but my opinion doesn't really matter)

    He also claimed at one point that he was shooting at sea lions. So maybe the illegal immigrant with several drug arrests isn't the most trustworthy person on earth.

    I wonder if that came up at trial. I wonder whether it was admissible. If not, we can understand why the jury might believe him.
