    The problem is, of course, that cops have too much discretion. Any of us can be arrested while driving for "weaving in our lane".

    This must be limited, to avoid bullying by the police.

    Again, please cite a precedent where the decision is based on this argument.

    In theory, the 1st amendment still does not protect obscene speech and images. But in reality, nothing is obscene anymore other than child porn.

    Right. So in that case, the lady cannot be charged with DTP based on acts that would have been legal in another public space.

    E.g., the library parking lot.
