    Oh, they should be fired, too. For cause. And prosecuted for perjury. And never be allowed to hold another job in any sort of law enforcement ever again. Or serve in the military. You get the idea.

    Sorry but wrong view. They should be made to pay substantially each and every time in order that they are made an example of and learn from their mistakes. Though in effect, they just keep on making previously known "mistakes" as they just LOVE to enrich citizens who sue them for it knowing full well they will win in court most every time!

    In Missouri, a percentage (up to 50%) goes to the "Tort Victims' Compensation Fund," pursuant to 537.675 R.S.Mo.

    Interesting. Is that a percentage of the entire award, or just the punitive damages? And what is that Fund actually for?

    Just the punitive damages. It is to compensate tort victims who were inadequately compensated for their injuries due to policy limits being less than the value of their claims.

    Didn't realize that. A good start.

    Don't agree with any of the punitive damages going to the plaintiff. Just sets a foundation for "litigation lottery" in many cases. As noted above, am all for victims receiving their appropriate Actual damages. But the punitive element is essentially a court fine. And it makes little sense for that "fine" to go anywhere but the the court/public coffers. The punishment is the same either way.

    Are you fucking kidding me? This man was assaulted by agents of the state. They lied under oath. With a bond of over $800,000,he was facing some serious prison time. He deserves every fucking penny he got. Don't like it? Stop electing assholes who condone this shit. Stop making excuses for bad cops. Make sure these fuckers are fired. They aren't allowed to resign. Fire them. Make sure they NEVER work in law enforcement anywhere ever again. Not as a cop. Not as security in a Wal-Mart. Nothing. They lose their fucking pension.

    How's this? Any and all punitive damages can come from the police pension fund.

    This will take a long time for him to recover from. He deserves everything he was awarded.
