    can Jemele Hill sue Trump?

    the POTUS can't ordinarily be sued in connection to his official functions. However, posting misleading and slanderous comments about a sports announcer , trying to get her fire, etc....that's not part of his official functions. She should explore whether or not she can sue his ass.

    In the 1997 case Clinton v. Jones, in which former Arkansas state employee Paula Jones accused President Bill Clinton of sexual harassment, Clinton invoked presidential immunity in an attempt to have the civil suit against him suspended. But the court ruled that sitting presidents could be subject to civil lawsuits in federal court over non-official acts. The decision only applies to litigation at the federal level, however, and did not address whether a president is immune from civil lawsuits over private issues in state court.

    Two people who said bad stuff about each other, does not make a legal case.

    She should try to learn her lesson from this suspension, and be thankful that she still has a good paying job.

    Can she show damages? And if not, are the comments defamation per se?

    Chances are the issue would have to be litigated for us to find out. The Supreme Court ruled the Jones case against Prez. Clinton could go forward, but that was for acts committed before he took office. She might have to wait until he leaves.

    Truth is a defense to defamation. But once the plaintiff shows the statements false by preponderance of the evidence, the defendant would then have the burden of demonstrating they are true (by the same standard, which would defeat the plaintiff's contention).

    Another defensive strategy would be that statements were rendered as opinion rather than represented to be factual.
