    Gorsuch is in a very bad position. He is not a judicial activist; however, the expectation is that he would go along if the Supreme Court revisits decisions that are contrary to the original interpretation of the Constitution - especially those decisions that are reinterpretations of earlier Supreme Court decisions.

    In essence, the question is: Will the Supreme Court reinterpret the current reinterpretations of constitutional law? And, if so, how does the Court then address the fact that it appears they are legislating from the bench by restoring the earliest court precedents?

    I voted "maybe." I'm not entirely sure what you mean by "ideological." If you mean it in the purely political sense, I don't think so. If you mean it in the judicial philosophy sense, then he may well be.

    You did not offer the correct answer in your poll

    Scalia was not ideologicly driven. he was an originalist and interpreted the constitution as it was written. Gorsuch says he will do the same.


    The constitution is what it is until the Congress by 2/3rds vote in both houses and 2/3rds of the state Legislatures change it, Or it is changed via Constitutional Convention.
