    The minor should not be charged with any crime. It is the responsibility of the adult in the situation to obey the law and not be a perverted idiot. If you have a question to whether he/she is of age, then most likely he/she is too young to be messing with. It's a novel concept to actually know the person with which you are planning to have sex, and his/her age.

    Now, if the minor slips the teacher a mickey, and rapes the teacher, then the minor should be charged. Otherwise, HELL NO! Decisions have consequences. We just saw a case where a 50-year-old teacher took a teenage student across the country having sex with her. He needs to be so deep into the prison that they need a map to locate the cell.

    I am not saying that a murder victim gives consent; rather i was trying to show how ridiculous you statement was by comparing your question to a situation where there is a general consensus on who is responsible for a crime.

    The minor's age is the reason this is a crime, because they cannot correctly read a situation and how it will impact their lives.

    You should read the online responses to articles about those events .

    All agree that the man should be prosecuted , but many do not believe the girl was a poor innocent victim either .

    The girl did not try to escape and call for help and she likely wanted to run away .

    When i went to high school , there were adolescent boys and girls toying with their teachers and they were none too innocent in my mind .

    You retort does not make any sense .

    By definition , a rape is an act of violence against the free will of another .

    Apparently , the public is not willing to hold adolescents accountable for delinquency when it involves unlawful sex .

    It is not my position that the adult should avoid punishment .

    It is not my position that an adolescent is always innocent and deserving of defense by infancy .

    Since the adolescent is by law the victim of the sex crime, it would be bad public policy to charge him or her. Even if the adolescent is a "willing participant," he or she cannot consent, and therefore willing participation is not legally relevant.
