    Its either constitutional or unconstitutional, can't be both. The Supreme court says it constitutional. Many have attempted to have it stricken with no success.
    The one who couldn't get the phrase removed was unsuccessful because he was trying to get the phrase removed. That is, banned from being used by anyone, period. It is unconstitutional for the state to prevent anyone from using it.

    It is unconstitutional for the state to require someone to say something like "so help me God."

    None are needed. Everyone except you knows the Establishment Clause prevents the government from requiring someone to take part in religion.

    Generally people are uncomfortable not knowing the answer to questions. And different people find different ways to deal with this. Some attempt to find empirical answers, knowing that they may or may never succeed. Others are content with a pre-fabricated one-size-fits all answer.

    Canada, Australia, western Europe, and Japan are at least 50% non-religious or atheist.
    Close to 20% of Americans on the net are atheist. It may be higher than that. It's not like we're scarce yet American christians treat us like we have the plague.

    Yes, a simplistic, one-size-fits-all answer is very easy to believe and brings one comfort to think that life is that easy to understand. I learned this very well when I read about Scientology. You know...the one about the evil alien lord Xenu, and the alien parasites in our heads that cause our negative emotions. As they said on the South Park episode, this is what Scientologists actually believe.
