    U.S. confirms warrantless searches of Americans
    It's so blatantly not constitutional.
    The information was obtained in the following manner:
    Foreign communications are swept up for national security purposes. In reality, they are probably sucking up every single bit of foreign and domestic communication possible.
    Their "legal reasoning" for the authority to do this, is that the foreigners don't have civil liberties to violate, so the government is not prevented from seizing their communications without warrant.
    While I disagree with this, it is, unfortunately, on sound legal footing.
    Then they somehow claim that "because they obtained these communications via legal means" that it's not a violation of the civil liberties of the Americans who are a party to the communications.
    When did they lose their right to privacy?
    Communicating with anyone outside of the United States is not one of the exceptions to the 4th amendment. It's not illegal.
    So why exactly, do those Americans, no longer maintain a right to privacy?

    The short answer is the border exception. Congress regulates all foreign trade. If it crosses the border in any way shape or form, they can stop it, tax it, search it or for that matter even lay an embargo on it....
