    Yes, she can. Her personal beliefs are why she wouldn't sign them. Since he sued the Clerk of Court, the county pays the tab. That's how it works.

    I assume that by not firing her for refusing to do her job, the state took her on as a liability. Had they fired her and put somebody in who issued the marriage licenses, Kentucky would be absolved.

    But I'm no lawyer, and I don't know what it takes to fire a clerk like that.

    The Clerk of Court is one of four elected constitutional officers in a county. It is very hard to remove one. That is done for a reason. It has to do with political rivals trying to get rid of opponents. The other three constitutional officers are the coroner, sheriff, and probate court judge.

    From the story in the OP. It was just a question of whether Rowan County would pay it or the Commonwealth of Kentucky.

    He said Davis was protected because she was acting in her official capacity when she stopped issuing marriage licenses in 2015 on religious grounds after the Supreme Court held gay marriage is a fundamental right. He said the state rather than the county was liable because the state is primarily responsible for regulating marriage.
