    That has been my point from the beginning. Its the only crime I can think of where ones accuser can be anonymous and it can lead to one losing their livelihood. We had a dentist here locally in our paper who lost his job because he was "naughty" 30 years ago in college. Statute of limitations for criminal charges seem to have defined time periods for behavior. I agree its a horrendous thing but there has to be consistent standards, otherwise one emplpyee gets fired and another doesnt or one senator resigns and another doesnt.

    Ok but is there no line for fooling around? I mean if anyone ever watched the Carol Burnett show, Tim Conway was famous for "goosing" butts right as people were having their photo taken. He grabbed both men and women just to get that look in their photo for fun. Is that harassment? Or is part of being a prankster with no ulterior motive?

    To me its having a motive. For example sports athletes that slap butts (male or female) arent doing it for sexual reasons. Its just what they do.

    Actually, what you just described is the distinction between sexual harassment and sexual assault. Once there's unwanted physical contact, it's sexual assault, which is criminally actionable on top of being a fireable offense. Talking about it can* most certainly constitute sexual harassment - which isn't criminal, but may also be a fireable offense.

    Do you have an HR Director at your place of employment? You might benefit from speaking with him or her. If you're interested in actually understanding where the lines are, that is.

    *Please note I said "can." Different people have different levels of tolerance in terms of what sort of comments and conversation they'll find concerning enough to raise an issue. As a general rule, telling an employee or co-worker you're thinking about or would like to grab his/her genitalia isn't a smart idea if you'd like to keep your job. Telling someone that outside the context of the work place might not get you fired, but it might get you slapped or punched, or garner you some unwanted publicity, assuming you're not already in a romantic/sexual relationship with that person.

    I can say that where I work, people are now coming forward and asking for exact metrics to be decided. "Different tolerance levels" isnt working anymore. People really are worked up about this and demanding specific answers. HR isnt happy these days!

    I'll bet!

    The only bright line is this: Avoid sexual topics and innuendo. That's not how a lot of people actually work/interact, but if the primary concern is avoiding claims, that's the safest route.

    I think the Democrats just shot themselves in the foot and lost a seat. You notice that the GOP is hanging on to their seats and not pushing any of their sexual harassers out the door. Democrats cannot afford to lose any more seats. It is a gamble for them to think they can regain enough seats to control the House and the Senate. I bet that atrocious healthcare bill goes through now.
