    The idea is two advocates, prepared and motivated, battling it out under strict rules so as to determine what happened and whose fault it is.

    I disagree; it isn't the verdict that makes someone a criminal, it's their actions. The verdict only determines whether they'll pay a penalty for their actions.
    While the jury is required to consider the defendant innocent until proven guilty, I'm free to judge as I please. And attorneys help guilty people go free every day.
    As to businesses, if there's an imbalance in the quality of legal representation I'm pretty sure someone is getting screwed.

    That's a philosophy question. Cain kills Able. Is it murder?

    Was Cain mentally ill? Did Able provoke him? Was there a surprise death from what Cain intended only as an assault?

    Etc.
