The fact that Gaetz’s (now deleted) tweet was public, as opposed to caught on a covert recording, does not detract from its potentially criminal nature.

"Just when you thought America’s political discourse could sink no lower, Congressman Matt Gaetz took to Twitter on Tuesday afternoon to offer this pearl of wisdom ahead of former Donald Trump fixer Michael Cohen’s testimony in front of the House Oversight Committee: “Hey @MichaelCohen212 – Do your wife & father-in-law know about your girlfriends? Maybe tonight would be a good time for that chat. I wonder if she’ll remain faithful when you’re in prison. She’s about to learn a lot.” The representative’s impressive impersonation of a mafia don aside, this public missive — especially given its timing — almost certainly constitutes witness tampering, a federal crime."
"Federal law prohibits “tampering with a witness, victim, or an informant” (18 U.S. Code sec. 1512). In other words, it is a crime to knowingly intimidate, threaten or corruptly persuade or attempt to persuade someone to delay, change or back out of testifying in an official proceeding."
"Of course, this is not the first time Michael Cohen has been threatened on social media, presumably in an attempt to keep him from disclosing information about presidential misconduct. Trump himself issued a tweet in January that itself arguably flirted with witness tampering. At the very least, the fact that the president was accusing Cohen of lying seems like yet another example of presidential overreach and meddling with other branches of government, namely the judicial branch."

That is also an important part of what House Democrats on the Committee holding the Cohen hearing should also be investigating. There is enough there to initiate a good inquiry into the matter after important questions have been raised and that should indeed happen.

Gaetz is under investigation by the Florida Bar Association for professional misconduct. He could well be disbarred over this, but it will likely result in a lesser penalty for a first-time offense. The premise is completely valid and it will result in sanctions for the offender. That's why he took the tweet down and apologized.

I think we should have a law in America, that, if you can be charged with Witness Tampering, that person should have his/her tonge removed.

Anyone want to place bets on whether Gaetzs gets charged with Witness Tampering?

Anyone?
A single tweet which has been retracted and for which the offender has apologized likely will result in no criminal liability.

But let's be clear, Gaetz took the tweet down and apologized because it was a serious error that put him in hot water.

Hang on ... The Atlantic is reporting that Gaetz took a call from the president last night in which Gaetz told the president that he was "happy to" put out the tweet threatening Cohen on the president's behalf. If that's accurate, and can be substantiated by any means, whatever benefit Gaetz gained from apologizing and deleting the tweet is out the window.

Gaetz really doesn't appear to be the sharpest tool in the shed. The bar association will not mess around with this — lawyers are not allowed to threaten people.
