Police Investigators Determined Officer Choked Eric Garner

Internal affairs investigators who reviewed Eric Garner’s death determined that the officer who wrestled him to the ground in 2014 used a forbidden chokehold on him, a police supervisor testified on Monday during the officer’s disciplinary trial at Police Headquarters.

The revelation raised questions about why the Police Department never took independent action against the officer, Daniel Pantaleo, but instead allowed him to remain on desk duty for five years as a federal investigation dragged on. The Police Department did not respond to an email seeking comment.

Good, now arrest the mother fucker and try him for murder. I for one am not against a "choke hold", but it should be used with discretion and when the situation calls for it. To subdue a person over loosies, is not one of those times.

Agreed. However, from the article:

"Inspector Barton, who oversaw the internal review, said he recommended disciplinary charges against Officer Pantaleo in January 2015, after a grand jury declined to bring criminal charges."

Could a grand jury be reconvined given this new evidence? At least the garners have a payday coming now.

Possibly, though I am not familiar with the relevant state law on the matter. Obviously, there would have to be new evidence, as the DA cannot keep trying hoping he gets a GJ willing to indict eventually (and this assumes no SOL, which is the case for murder of course).

Headlocks and chokes are two entirely different things with entirely different results.
Chokes are for cutting off blood flow and oxygen to the brain.
Headlocks are for absolute submission without the need to cut off essential organs.
Both can be equally effective but one has very little chance of killing someone.

It's amazing it took the nypd what 5 years to figure out what most of us did in 30 seconds.

Eric Gardner died of a heart attack in the back of an ambulance. He wasn't choked to death. And he was grossly overweight contributing to the cardiac arrest.

So that will probably be part of the equation when the prosecutor considers pressing murder charges.
